Under the Trade Marks Act, 1999, trademark registration in India is not permanent on a one-time grant. Registered trademarks are granted for a statutory period of 10 years from the application filing date and must be renewed periodically to maintain active legal protection.

Normal Renewal
The standard renewal window opens 1 year (or 6 months) before the 10-year expiration date. Regular statutory fees apply via Form TM-R without any surcharge.
Late Renewal
If renewal is missed before the expiry date, a 6-month grace period is available. The mark can still be renewed on Form TM-R by paying prescribed statutory surcharge fees.
Restoration & Renewal
If not renewed within 6 months post-expiry, the mark is marked 'Removed'. It can be restored and renewed between 6 months to 1 year post-expiry with restoration fees and grounds.
