Under Section 4 of the Indian Telegraph Act, establishing and operating a data communication network without a valid DoT license is strictly unlawful. Holding a valid ISP license establishes statutory legitimacy, allows direct procurement of wholesale bandwidth from national carriers, enables assignment of IP resources via IRINN/APNIC, and ensures lawful interconnection with National Internet Exchange nodes (NIXI).

ISP License Categories (Category A, B & C)

Under the Unified License (ISP) framework, licenses are demarcated into three territorial tiers:

Category A (National)

All-India Service Area

Permits the operator to establish network infrastructure and deliver internet services throughout the entire geography of India without circle boundaries.

Category B (Circle / Metro)

Telecom Service Area (TSA)

Authorizes internet network operations within a designated state, telecom circle, or metro service area (e.g., Delhi, Mumbai, Karnataka, Tamil Nadu).
